Please confirm that we have clear and express instructions from the beneficiary (Philip) and executor to represent them in these proceedings. In this regard we require to receive a copy of the writ in the Greek language together with the English translation and summons served (presumably) in Australia. We also require an original or if not available, a copy of the rental agreement which is mentioned as having expired on 26 August 2005.
URGENT QUERY
In order to register the grant of probate with the Athens Court, Philip shall need to produce, an office copy of the grant incorporating the Will, as well as the death certificate. These documents must be apostilled under the Hague Convention and translated into Greek by a Greek lawyer or official authority. For the inheritance acceptance the Greek notary shall require the above document, the Athens Court Will registration certificate, a certificate from the Athens Court that no other later Will of the deceased has been recorded with this Court and a certificate from Athens Court that there is no pending dispute concerning the Will recorded with this Court. If the deceased was registered with a local municipality (for example if she or her spouse had been born in Greece), the notary might ask for a certificate or sworn declarations regarding whether there are other relatives of the deceased of the same degree as the beneficiary i.e : his siblings. In such a case the notary might request declarations from his siblings that they have no claim to the inheritance. However it should be stressed that this latter requirement is not strict and thus it may well be that the notary in question may not request such certificate or declarations, in which case Philip may accept the inheritance and proceed to register the notarial deed with the land registry.
